Better Soda, Inc. doing business as PRODA ("PRODA," "we," "us," or "our") operates drinkproda.com, our Shopify store, Shop and Shop Pay-enabled experiences, customer accounts, forms, communications, and related services (collectively, the "Services"). This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit or use the Services, purchase from us, start or manage a subscription, contact us, enter a promotion, or otherwise interact with us.
This Privacy Policy does not govern a third-party website or service that has its own privacy notice, including Amazon, Google Maps, or a social-media platform. If you follow a link to a third-party service, review that service's privacy notice.
1. Personal Information We Collect
Depending on how you interact with us, we may collect or process:
- Identifiers and contact information, such as your name, email address, telephone number, billing address, shipping address, account identifiers, and IP address.
- Order and commercial information, such as products viewed, searched for, added to a cart, purchased, subscribed to, returned, or canceled; quantity, price, discount, delivery cadence, order status, fulfillment status, and transaction history.
- Payment and transaction information. Shopify and participating payment providers process payment-card or financial-account details. We receive transaction identifiers, payment status, and limited billing information needed to process and support a purchase, but we do not receive every payment credential handled by those providers.
- Account and preference information, including login and account settings, saved choices, Shop or Shop Pay authentication and preferences when you choose to use those services, communication preferences, subscription selections, and consent records.
- Device, network, and usage information, including browser and device type, operating system, network connection, IP-derived approximate location, referring pages, pages and products viewed, links clicked, searches, scrolling, cart and checkout activity, and similar interaction data.
- Analytics and experience information, including analytics events, browser errors, feature-flag or experiment assignments, survey responses if a survey is presented, and consent-gated session replay. After you grant analytics consent, PostHog session replay may begin upon your first pointer, keyboard, or scroll interaction, or after approximately 2.5 seconds, whichever comes first. Replay is not started on password or customer-account pages. Form input values and designated account, address, and order text are masked. A replay may capture other visible page content, page URLs, clicks, pointer movement, and scrolling.
- Marketing and advertising information, including email and SMS consent, subscription and suppression status, campaign source, advertisements viewed or clicked, and engagement with our communications.
- Communications and submitted content, including information you provide through newsletter, contact, wholesale, giveaway, survey, review, or customer-service forms. Business forms may include company, role, and business-contact details.
- Social interactions and support records, including social-media usernames and profile information made available to us, messages and comments you send to our business, the keyword or promotion you respond to, contact details you choose to submit, and the content, attachments, timestamps, outcomes and routing of service conversations. Where we can identify you, we may link these records with your customer profile and relevant order information.
- Location information you choose to provide, such as a ZIP code or location entered to find a nearby retailer. If you open a Google Maps result, Google receives the search or location request under Google's own privacy notice.
- Inferences, such as likely product interests or audiences derived from the information described above.
2. Sources of Personal Information
We may collect personal information:
- directly from you when you place an order, create an account, subscribe, complete a form, contact us, or otherwise provide information;
- automatically through cookies, pixels, local storage, server logs, and similar technologies when you use the Services;
- from Shopify, Shop, Shop Pay, Amazon, payment providers, fulfillment providers, carriers, Klaviyo, PostHog, and other vendors that provide services to us;
- from advertising, analytics, and marketing partners; and
- from another source at your direction or with your consent.
3. How We Use Personal Information
We may use personal information to:
- operate, maintain, personalize, test, and improve the Services;
- process payments, orders, subscriptions, shipping, deliveries, returns, refunds, and customer-account activity;
- authenticate accounts and remember preferences;
- provide customer service and communicate about a transaction, account, subscription, product, safety issue, or policy;
- conduct consent-gated analytics, error tracking, session replay, surveys, feature flags, and experiments;
- measure advertising, create audiences, attribute conversions, and show advertising that may be based on activity across websites or services, other than the mobile opt-in and SMS consent data described in Section 7;
- send promotional email or SMS when permitted and maintain suppression lists when you opt out;
- administer offers, giveaways, and promotions;
- detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
- comply with legal obligations, respond to lawful process, establish or defend legal claims, and enforce our policies; and
- protect the rights, safety, and property of PRODA, our customers, and others.
Our customer-service tools may provide automated answers, use available account or order information to help with your request, and pass conversation history to our team for review and follow-up. We use support records to respond, route requests and assess service quality. Asking for help, opening a chat or providing details for an order does not by itself enroll you in marketing.
4. How We Disclose Personal Information
We may disclose personal information to:
- Shopify, Shop, Shop Pay, and payment providers for store hosting, customer accounts, accelerated checkout, payments, fraud prevention, subscriptions, discounts, and related commerce services.
- Amazon and delivery providers for Amazon Multi-Channel Fulfillment, Buy with Prime or other eligible Prime-related services, delivery, tracking, returns, and support. The information needed for fulfillment may include a recipient's name, delivery address, contact information, order details, and delivery instructions.
- Klaviyo for forms, Shop-enabled lead capture, social-media sign-up conversations, customer profiles, channel-specific email and SMS consent, messaging, automated web support, helpdesk tickets and conversation history, audience management within our own email and text messaging programs, discounts, and campaign measurement.
- Social-media platforms, including Meta, to receive and respond to messages and comments you send to our business, display service menus, and provide sign-up prompts you request within those platforms. Their own privacy notices also apply to your use of their services.
- PostHog for consent-gated analytics, error tracking, session replay, surveys, feature flags, and experiments.
- Advertising and measurement partners, including Google, Meta, TikTok, and Shopify, for product listings, advertising, audience measurement, attribution, and campaign optimization. We do not provide your mobile opt-in and SMS consent data to these partners for advertising or audience targeting. We provide your text message consent choice to Shopify only so that it is recorded on your customer record and honored, as described in Section 7.
- Website and business-service providers that support forms, hosting, security, fraud prevention, customer service, accounting, legal, or other business functions.
- Affiliates and transaction parties, including a prospective or actual buyer, lender, successor, or adviser in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business.
- Government, legal, and safety recipients when disclosure is required or permitted by law, lawful process, a valid request, or reasonably necessary to protect rights, safety, or property.
- Other parties at your direction or with your consent.
5. Shopify
Our store is hosted by Shopify. Shopify collects and processes personal information about access to and use of the Services to provide its platform and related services. In some circumstances, Shopify is independently responsible for its processing. Learn more in the Shopify Privacy Policy and manage certain Shopify choices through the Shopify Privacy Portal.
If you choose to use Shop, Shop Pay, Sign in with Shop, or a Shop-enabled lead-capture experience, Shopify may recognize or authenticate your Shop account and use information you previously saved with Shopify to prefill checkout or an optional SMS sign-up step. A discount offered through a qualifying form may be saved to your Shop account and applied when you check out with Shop Pay. Shop authentication or a prefilled telephone number does not itself create promotional SMS consent; we treat only a separate affirmative SMS choice as SMS marketing consent.
6. Cookies, Analytics, and Targeted Advertising
We and our partners use cookies, pixels, local storage, and similar technologies for necessary store functions, preferences, analytics, marketing, fraud prevention, product-listing and merchant services, attribution, and advertising. These technologies may be provided by Shopify, Klaviyo, PostHog, Google, Meta, TikTok, and other vendors described in this Policy. PostHog analytics capture and session replay begin only after analytics consent is granted.
Links in social posts, messages and offers may contain campaign tags or use a campaign-specific discount code. We use those details to associate visits, sign-ups and qualifying purchases with an offer or source, subject to the privacy choices described here. This does not change the restrictions on mobile opt-in and SMS consent data in Section 7.
We do not sell personal information for money. We may disclose identifiers, commercial information, internet or electronic activity, approximate location, and related inferences to advertising and analytics partners for targeted or cross-context behavioral advertising. Some state laws define these disclosures as a "sale," "sharing," or targeted advertising.
These disclosures for targeted or cross-context behavioral advertising do not include your mobile opt-in and SMS consent data. As described in Section 7, we do not sell, rent, or share that information with third parties or affiliates for advertising purposes or for their own marketing.
You may opt out of sale, sharing, or targeted advertising through Your Privacy Choices. If that control is unavailable, email Info@drinkproda.com with the subject line "Privacy Opt-Out Request." You may also change cookie choices through the Cookie Preferences control where it is displayed. Where required by applicable law, we treat a supported browser-based universal opt-out signal, such as Global Privacy Control, as an opt-out request for the browser or device sending the signal and, where we can reasonably associate the signal, the related account.
We do not knowingly sell or share personal information of consumers under 16 years of age. We use account login, payment, and similar sensitive personal information only as reasonably necessary to provide requested services, protect accounts and transactions, and meet legal obligations. We do not intend to use that information to infer characteristics about you.
7. Email and SMS
You may unsubscribe from promotional email using the unsubscribe link in any message. If you separately consent to promotional text messages, you agree to receive recurring automated marketing text messages from PRODA at the number provided, which may include cart or checkout reminders. Message frequency varies and message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out or HELP for help. Even after you opt out of marketing, we may send non-promotional communications about an account, order, subscription, safety issue, or our ongoing business relationship as permitted by law.
Email and text sign-ups may be offered separately through website forms or social-media messages. Follow any email or text confirmation instructions to complete the subscription you requested. Joining an email list, replying with a promotional keyword or receiving a shopping link does not by itself authorize promotional texts. Text enrollment is optional and is not required to use an email sign-up offer or make a purchase. If you choose to submit a sign-up through a social-media message, the platform processes that message under its own privacy notice; we use the sign-up information to provide the requested messaging program and honor your choices.
Mobile opt-in and SMS consent data. In this Policy, "SMS" and "text messages" include SMS, MMS, and RCS messages. Mobile opt-in and SMS consent data means your SMS consent and opt-out status, the opt-in records we keep, and our text messaging list. We do not sell, rent, or share your mobile opt-in and SMS consent data with third parties or affiliates for advertising purposes or for their own marketing. Your text message consent will not be shared with any third parties for purposes unrelated to delivering the messaging service. The only exception is a disclosure required by law or lawful process, as described in Section 4. We do not build or match advertising audiences from our text messaging list, and joining our text messaging program does not place you in an advertising audience. If our business is transferred as described in Section 4, our text messaging program may transfer with it, and we will require the recipient to honor the commitments in this Section and your opt-out.
We disclose mobile opt-in and SMS consent data in a form that identifies you only to the providers that operate our text messaging program and the sign-up forms through which you opt in, such as Klaviyo and Shopify, and to telecommunications carriers, messaging aggregators, form providers, and customer-service providers, in each case as needed to send messages, record and honor your choices, and respond to your requests. Where you have granted analytics consent, our analytics provider receives a record that a form was submitted and which message channels you requested and we accepted, keyed to a random lead capture identifier and never to your telephone number, name, or email address. That record is not our text messaging list and is not used for advertising or to build advertising audiences.
Your telephone number itself is an identifier described in Section 1, and we use and disclose it as described in Sections 3 and 4. That may include sharing a hashed telephone number with advertising partners to match an order to an advertisement, based on your order and site activity rather than on your SMS consent. Giving a delivery or account telephone number does not opt you in to PRODA text messages.
8. Retention
We retain personal information only as long as reasonably necessary for the purpose for which it was collected and as required or permitted by law. We apply the following criteria:
- Contact, account, and preference information is generally kept while an account, subscription, or customer relationship remains active, and afterward as needed for support, security, suppression records, disputes, and legal obligations.
- Order, payment, fulfillment, and transaction records are generally kept for the periods needed for delivery, returns, chargebacks, fraud prevention, tax, accounting, product-safety, and legal obligations.
- Consent and communication records are generally kept while the consent applies and afterward for the period needed to honor opt-outs, document consent, and meet legal obligations.
- Device, analytics, advertising, and experience information is generally kept according to configured vendor retention periods and only as long as needed for security, measurement, attribution, testing, and improvement.
- Customer-service communications and submitted content are generally kept through resolution and afterward as needed for support, disputes, contract limitation periods, and legal obligations.
When information is no longer needed, we delete or deidentify it unless continued retention is required or permitted by law.
9. Security
We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Children
The Services are not directed to children under 13. We do not knowingly collect personal information from a child under 13. If you believe a child provided personal information to us, contact us so we can review and address the request.
11. Your Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
- confirm whether we process personal information about you;
- access, correct, or delete personal information;
- receive a portable copy of personal information;
- obtain information about categories or specific third-party recipients;
- opt out of sale, sharing, targeted advertising, or qualifying profiling;
- limit certain uses or disclosures of sensitive personal information;
- withdraw consent where processing is based on consent;
- appeal a decision on a privacy request; and
- receive equal service and pricing without unlawful discrimination for exercising a privacy right.
To request access, correction, deletion, portability, withdrawal of consent, or an appeal, email Info@drinkproda.com with the subject line "Privacy Request." To opt out of sale, sharing, or targeted advertising, use Your Privacy Choices or, if the control is unavailable, email us with the subject line "Privacy Opt-Out Request." An authorized agent may submit a request where permitted by law. We may verify identity or authority using information reasonably necessary for the request. We will respond within the period required by applicable law.
12. United States State Privacy Disclosures
During the preceding 12 months, we may have collected the categories described in Section 1 and disclosed them for the business and commercial purposes described in Sections 3 and 4. Those disclosures may include:
- Identifiers and customer-record information disclosed to commerce, payment, account, customer-service, marketing, fulfillment, delivery, security, and professional-service providers.
- Commercial and transaction information disclosed to commerce, payment, subscription, fulfillment, delivery, analytics, advertising, and customer-service providers.
- Internet or electronic activity, approximate location, and inferences disclosed to commerce, analytics, website, security, advertising, and measurement providers.
- Communications and submitted content disclosed to form, communications, customer-service, promotion, and professional-service providers.
For targeted or cross-context behavioral advertising, we may have shared identifiers, commercial information, internet or electronic activity, approximate location, and inferences with advertising and measurement partners. We do not have actual knowledge that we sold or shared personal information of a consumer under 16 years of age. We do not sell personal information for monetary consideration. We do not sell, rent, or share mobile opt-in and SMS consent data for advertising, as described in Section 7.
Notice of Financial Incentive
PRODA may offer a voluntary one-time discount, such as 15% off an eligible direct order, to a customer who affirmatively joins our email marketing program. The offer shown when you enroll will identify eligibility, exclusions, expiration, and other material terms. Participation is optional and is not required to make a purchase.
The personal information involved may include your email address, consent record, campaign and engagement information, Shop or Shop Pay recognition or authentication status when a Shop-enabled form is used, a discount saved to your Shop account, and order information if you redeem the offer. We use this information to provide the offer, send marketing you requested, understand campaign performance, and personalize communications.
For an offer requested through social media, this information may also include your social-media handle, the keyword you responded to, and the associated campaign source.
You opt in by submitting the requested information and affirmatively joining the program. You may withdraw at any time by using the unsubscribe link in an email or contacting Info@drinkproda.com. Withdrawal does not affect a discount already applied or processing completed before withdrawal.
The value of the benefit is the dollar amount of the discount actually applied to an eligible purchase. We estimate that the value of participant information is reasonably related to that benefit. Our good-faith method considers anticipated revenue and engagement attributable to participating customers, less the costs of providing and administering the program, divided by the number of participating customers.
13. International Processing
We and our providers may process personal information in the United States and other countries. Where applicable law requires a transfer safeguard, we rely on a legally recognized mechanism.
14. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes to our practices, Services, or legal obligations. We will post the revised version, update the "Last updated" date, and provide additional notice or obtain consent when required by law.
